Legal team raises concerns for Morsi family members that remain in Egypt
Calls on the US government to fulfil its legal responsibility to the children of Dr Morsi with American citizenship
Demands process of justice to discover true circumstances of former leader’s death
Establishes Foundation in the name of the former President
LONDON (17 June 2020) – On the anniversary of President Mohamed Morsi’s death, the family’s international legal team has called on the US administration to act on their legal responsibility towards the late Egyptian leader’s children that hold American citizenship and face persecution under President Sisi’s regime. It further calls on the UN to ensure that an effective investigation is conducted into the death of the first democratically elected civilian President of Egypt and that the perpetrators are brought to justice.
The Morsi family members that remain in Egypt have been subjected to harassment and political retaliation. Osama Morsi remains arbitrarily detained and has not been seen by the family since he attended his brother Abdullah’s secret burial. Abdullah – the youngest son – died in mysterious circumstances less than 3 months after his father's death. Other family members continue to face daily state-backed harassment.
Dr Morsi collapsed in court on the 17th June 2019. His death was the result of the inhuman and degrading treatment he had ensured during a lengthy and cruel period of detention since the 2013 military coup that illegally removed him from power.He was subjected to lengthy periods of incommunicado confinement, denied basic rights and held in conditions considered degrading and in breach of his fundamental rights. His human rights, fundamental freedoms and constitutional protections were persistently violated, and medical care and food deliberately withheld. His family were prevented from visits and the State interfered with his basic right to consult his lawyers.
No formal investigation has taken place into the circumstances of his death. The legal team restate their demand for a judicial process to establish the truth and hold those responsible to account.
According to United Nations Special Rapporteur on Extrajudicial, Summary or Arbitrary Executions, Dr. Agnes Callemard, his death “could amount to a State-sanctioned arbitrary killing”. UN human rights experts have further stated that President Sisi’s prison regime may be putting thousands more lives at risk, intentionally violating prisoner’s rights as part of a strategy to silence opposition.
On the anniversary of the death of the former President, the Morsi Foundation for Democracy was officially established in the United Kingdom, as instructed by Abdullah Morsi – the son of the former President – before his own tragic death. It will serve as an international civil society movement: a non-profit organisation that stands for freedom and democracy across the world. It will support everyone who fights corruption, tyranny and occupation: a platform for justice and peace across the globe.
Commenting on the anniversary, barrister Toby Cadman, counsel to the family, stated:
“That President Morsi died in a courtroom is indicative: the organs of justice in Egypt have been circumvented to serve a brutal regime that stamps out all dissent. A year after his state-sanctioned killing, the Sisi regime continues to target journalists, political opponents and all forms of dissent. Unless the international community takes action, hundreds, if not thousands, of other innocent citizens are destined to the same fate as the former president.”

لندن (17 يونيو/حزيران 2020) - في ذكرى وفاة الرئيس محمد مرسي، دعا الفريق القانوني الدولي المعني بالدفاع عن عائلة مرسي الإدارة الأمريكية إلى التصرف بناء على مسؤوليتها القانونية تجاه أولاد الزعيم المصري الراحل والذين يحملون الجنسية الأمريكية ويواجهون الاضطهاد في ظل نظام الرئيس السيسي. كما دعا الأمم المتحدة إلى ضمان إجراء تحقيق فعال في وفاة أول رئيس مصري مدني منتخب ديمقراطياً وتقديم الجناة إلى العدالة.
تعرض أفراد عائلة مرسي الذين بقوا في مصر للمضايقة والانتقام السياسي. لا يزال أسامة مرسي محتجزاً احتجازاً تعسفياً ولم يره أحد منذ أن حضر الدفن السري لأخيه عبد الله. توفي عبد الله - الابن الأصغر - في ظروف غامضة بعد أقل من 3 أشهر من وفاة والده. ولا يزال أفراد الأسرة الآخرون يواجهون المضايقات
اليومية المدعومة من الدولة.
انهار الدكتور مرسي في المحكمة في 17 يونيو 2019. وكانت وفاته نتيجة للمعاملة اللاإنسانية والمهينة التي حصل عليها خلال فترة احتجازه الطويلة والقاسية منذ الانقلاب العسكري عام 2013 والذي أطاح به بشكل غير قانوني. تعرض خلال الاحتجاز لفترات طويلة من الحبس الانفرادي وحُرم من حقوقه الأساسية واحتُجز في ظروف مهينة في انتهاك لحقوقه الأساسية. وأيضا انتهكت حقوقه الإنسانية وحرياته الأساسية وحمايته الدستورية بشكل مستمر، وتم حجب الرعاية الطبية والطعام عنه عمداً. ومُنعت عائلته من زيارته وتعرضت السلطات لحقه الأساسي في استشارة محاميه.
لم يتم إجراء تحقيق رسمي في ملابسات وفاته. يعيد الفريق القانوني مطالبته بإجراء تحقيق قضائي لإثبات الحقيقة ومحاسبة المسؤولين.
وفقاً للمقرِّرة الخاصة في الأمم المتحدة، د. أغنيس كاليمارد، المعنية بحالات الإعدام خارج نطاق القضاء أو بإجراءات موجزة أو تعسُّفاً، فإن وفاته "يمكن أن يرقى إلى "القتل التعسفي بإقرار الدولة المصرية ". كما ذكر خبراء حقوق الإنسان التابعون للأمم المتحدة أن نظام سجون الرئيس السيسي ربما يعرض آلاف الأرواح للخطر،
وينتهك عمداً حقوق السجناء كجزء من استراتيجية لإسكات المعارضة.
في ذكرى وفاة الرئيس السابق، تم إنشاء "مؤسسة مرسي للديمقراطية" رسميًا في المملكة المتحدة، بناء على توجيهات عبد الله مرسي - نجل الرئيس السابق - قبل وفاته المأساوية. وستكون بمثابة حركة مجتمع مدني دولية: منظمة غير ربحية تدافع عن الحرية والديمقراطية في جميع أنحاء العالم. ستدعم كل من يحارب الفساد
والاستبداد والاحتلال كمنصة للعدالة والسلام في جميع أنحاء العالم.
تعليقا على الذكرى، قال المحامي توبي كادمان، مستشار عائلة مرسي:
"إن وفاة الرئيس مرسي في قاعة المحكمة أمر له دلالة: تم التحايل على أجهزة العدالة في مصر لخدمة نظام وحشي يقضي على كل المعارضين. فبعد مرور عام على مقتله الذي أقرته الدولة، يواصل نظام السيسي استهداف الصحفيين والمعارضين السياسيين وجميع أشكال المعارضة. وما لم يتخذ المجتمع الدولي إجراء، فإن المئات، إن لم يكن الآلاف، من المواطنين الأبرياء سيلقون نفس مصير الرئيس السابق".
